TERMS OF SERVICE FOR PRIVATE COMMISSIONS

Currency accepted is EUR and can be paid through PayPal.
Commissions can be paid either 100% upfront or split 50% upfront and 50% after sketch approval.
Don't send me any payment before I have agreed to give you a slot and requested you to send me the payment.

Depending on factors such as the complexity of the requested piece, the time it takes to finish your commission may vary between 1 week and 3 months.
The finished piece will be delivered digitally as a full-resolution image. If you require aspecific image size or resolution, please add the desired measurements in the “Commission description” field

You get three rounds of changes on the commissioned piece included in the price. You will be informed when you used one of the three changes.
A fee will be added if you want something changed on the final drawing - unless a misunderstanding from my side has been made.
If you wish for me to change something in the drawing you have previously approved, I will charge you a fee to change it. The amount of the extra charge depends on the change you want me to make and is usually based on an hourly wage.
If your reference is unclear to start with changes will come at an extra charge.

I, Pinkiosella (the artist):
- retain all copyrights over the commissioned artwork.
- will NOT claim the intellectual property of the commissioned artwork.
- will NOT profit further from the commissioned artwork unless you (the customer) break any of the terms.
- reserve the right to post the commissioned artwork online and in my portfolio.
You (the customer/commissioner):
- may upload the commissioned artwork on any website and social channels, as long you give me credit for the work.
- may NOT alter the commissioned artwork without my (the artist's) consent.
- retain the rights to the intellectual property.
- may NOT use the commissioned artwork for commercial purposes (e.g.: reselling redistribution, uploading to POD-services, make prints, etc.)

The following is considered copyright infringement:
- Reproducing/using the copyrighted artwork commercially - means making money off it in any way not excluded from these terms.
- Claiming the artwork as your own
- Altering the artwork without my consent
In some cases, the commercial rights to the image may be purchased. A purchase of commercial rights to the artwork will always be 300% of original price.
- (With commercial rights you are allowed to make any sort of merch with the artwork. Use it in books, covers, as Props, change it to your liking and promote your own brand with. Credit is still required for usage of the artwork, even if altered or edited.)

If you’d like the commission to remain private (not ever published anywhere), an extra can be charged. Please mention so in the “Commission description”.

Until work on the requested commission begins, a refund is possible.
If I am unable to start working on your commission, you will receive a full refund.
Once work on the requested commission has begun, a refund is no longer possible.
If you wish to cancel your order, please contact me directly and do not request a Paypal chargeback. I will transfer your money back to you myself.
If you request a Paypal chargeback at any point when you were not allowed to ask for a refund you will lose all beforementioned rights to the commissioned piece and I will have the full right to profit further from it in any way. I will decline the chargeback and supply Paypal with our conversations in which we talk about the commission as evidence that I have completed work for you. Furthermore, you will be blacklisted for commissioning me again.

You will be directly involved in the creative process and will receive drafts and sketches to approve before my work continues
You can participate in guiding the color plan of your commission (depending on the complexity of the commission)
You will receive a full-resolution file (approx. 210 x 297 mm at 300 DPI) of the final drawing. If requested, I will adujst the frame size and resolution to your desire. Final file formats are usually JPEG.
